RELIGION AS A SPECIAL CATEGORY IN LAW AND POLICY:RELIGIOUS EXEMPTIONS AND FIRST FREEDOMSA DissertationbyBRADLEY GOODINESubmitted to the Office of Grad Raport_Institutul_de_Chimie_2011_2duate and Professional Studies of Texas A&M Universityin partial fulfillment of the requirements for the degree ofDOCTOR OF PHILOSOPHYChair of Committee, Committee Members,Head of Department.Elisabeth Ellis Diego von Vacano Judith Baer Theodore George Robert Harmel41609Major Subject: Political Scien Raport_Institutul_de_Chimie_2011_2ceCopyright 2013 Bradley GoodineABSTRACTAdvocates of religious exemptions and religious priority often stake their case on the belief that religion ocRaport_Institutul_de_Chimie_2011_2
cupies a special political category discrete from other ethical frameworks. Yet there remains a significant gap in the literature regarding the concepRELIGION AS A SPECIAL CATEGORY IN LAW AND POLICY:RELIGIOUS EXEMPTIONS AND FIRST FREEDOMSA DissertationbyBRADLEY GOODINESubmitted to the Office of Grad Raport_Institutul_de_Chimie_2011_2opposed to other ethical frameworks, should be seen as distinctive or prioritized. What is it about religion that would demand this level of protection? What conception of religion are we to use when thinking about how to order society? What, if anything, makes religion different from a legal perspe Raport_Institutul_de_Chimie_2011_2ctive? Although many scholars have addressed related issues, most contributions have glossed over the logically prior question of how we are to undersRaport_Institutul_de_Chimie_2011_2
tand religion theoretically. On the other hand, those who deny religious distinctiveness and priority have done little to systematically justify theirRELIGION AS A SPECIAL CATEGORY IN LAW AND POLICY:RELIGIOUS EXEMPTIONS AND FIRST FREEDOMSA DissertationbyBRADLEY GOODINESubmitted to the Office of Grad Raport_Institutul_de_Chimie_2011_2rlie these debates, focusing on theoretical accounts of what exactly religion is from a political perspective. I find that there are insufficient grounds for demanding categorically distinctive or priority treatment for religion on the level of politics. Arguments for such treatment are often circul Raport_Institutul_de_Chimie_2011_2ar and fail to accomplish their original aim of justifying why one subset of the population merits privilege. 1 do not argue that ethical exemptions tRaport_Institutul_de_Chimie_2011_2

Finally, undertaking a case study from contemporary Iiheral theory, I show that there are other theoretical resources for defending religion without resorting to an arbitra Raport_Institutul_de_Chimie_2011_2ry category.iiiDEDICATIONTo Bethanyivhttps://khothuvien.cori!ACKNOWLEDGEMENTSI would like 10 begin by thanking my outstanding professors at Baylor UniRaport_Institutul_de_Chimie_2011_2
